You may click the link to switch the active language.<\/p><p><\/p>\n<p style=\"text-align: justify;\">Nos termos do C\u00f3digo de Processo Civil a realiza\u00e7\u00e3o de penhora come\u00e7a pelos bens do executado cujo valor pecuni\u00e1rio seja de mais f\u00e1cil realiza\u00e7\u00e3o e se mostrem adequados ao montante do cr\u00e9dito exequente.<\/p>\n<p style=\"text-align: justify;\">A penhora pode todavia ser refor\u00e7ada ou substitu\u00edda pelo agente de execu\u00e7\u00e3o nas seguintes situa\u00e7\u00f5es:<\/p>\n<p style=\"text-align: justify;\">Quando o executado requeira ao agente de execu\u00e7\u00e3o, no prazo da oposi\u00e7\u00e3o \u00e0 penhora, a substitui\u00e7\u00e3o dos bens penhorados por outros, desde que o exequente n\u00e3o se oponha;<\/p>\n<p style=\"text-align: justify;\">Quando seja ou se torne manifesta a insufici\u00eancia dos bens penhorados;<\/p>\n<p style=\"text-align: justify;\">Quando os bens penhorados n\u00e3o sejam livres e o executado tenha outros que o sejam;<\/p>\n<p style=\"text-align: justify;\">Quando sejam recebidos embargos de terceiro contra a penhora, ou seja a execu\u00e7\u00e3o sobre os bens suspensa por oposi\u00e7\u00e3o a esta deduzida pelo executado;<\/p>\n<p style=\"text-align: justify;\">Quando o exequente desista da penhora, por sobre os bens penhorados existir penhora anterior;<\/p>\n<p style=\"text-align: justify;\">Quando o devedor subsidi\u00e1rio, n\u00e3o previamente citado, invoque o benef\u00edcio da excuss\u00e3o pr\u00e9via.<\/p>\n<p style=\"text-align: justify;\">Em caso de substitui\u00e7\u00e3o s\u00f3 depois da nova penhora \u00e9 levantada a que incide sobre os bens substitu\u00eddos.<a href=\"http:\/\/verdadeiroolhar.pt\/2015\/12\/30\/ordem-de-realizacao-de-penhora\/\" target=\"_blank\" rel=\"noopener\">Ler mais&#8230;<\/a><\/p>\n<p><\/p>","protected":false},"excerpt":{"rendered":"<p>Sorry, this entry is only available in Portugu\u00eas.
